Alternate Side Parking
Sec. 8-1-47 Seasonal All—Night Parking Restrictions.
(a) Prohibited. No person shall park or suffer any vehicle of any kind or description to be parked on any public highway or street of the City of Elroy, except temporarily for the purpose of and while actually engaging in receiving or discharging passengers from November 15 to April 1 of each year, between the hours of 2:00 a.m. and 6:00 a.m., inclusive, except as permitted herein.
(b) Alternate Side Parking. Except where prohibited by state law, all vehicles shall be parked only on even-numbered sides of the street on those days bearing an even calendar date and on the odd-numbered sides of the street on those days bearing an odd calendar date, between the hours of 2:00 a.m. and 6:00 a.m., except for the following streets on which vehicles shall always park on the side of the street as stated hereafter, every night of the week:
(1) The south side of Elroy Street and West Elroy Street from Western Avenue to Main Street;
(2) The south side of Division, Prospect Liberty, Nassau, Cedar and Center Streets;
(3) The west side of Academy Street from Badger Street to Prospect Street;
(4) The east side of Second Main Street from Elroy Street to Prospect Street;
(5) The east side of High and Spring Streets.
(6) The west side of Plymouth Street;
(7) The west side of Western Avenue from Prospect Street to W Elroy Street;
(8) The east side of Western Avenue from Prospect Street to State Hwy 71;
(9) The north side of Wisconsin Street from Academy Street to Hwy 71;
(10) The east side of N. Brooklyn and S. Brooklyn Ave.
(11) The west side of Second Main Street from Cedar Street to North Street
(c) Conflict. Where parking is normally prohibited, or otherwise restricted, said prohibitions or restrictions shall supersede this Section where in conflict therewith.
(d) Violations. Any person who shall violate any provisions of this Section shall be subject to a forfeiture of not less than Twenty Dollars ($20.00) nor more than Forty Dollars ($40.00); for a second (2nd) conviction within one year, the maximum forfeiture shall be not more than One Hundred Dollars ($100.00).
(e) Removal of Illegally Parked Vehicles. Any vehicles parked or left standing upon a highway or street of the City of Elroy in violation of the provisions of this Section is declared to be a hazard to traffic and public safety. Such vehicle shall be removed by the operator, upon request of any police officer to a position where parking, stopping or standing is not prohibited. Any police officer after issuing a citation for illegal parking, stopping or standing of an unattended vehicles in violation of this Section is authorized to remove such vehicle to a position where parking is not prohibited. The officer may order a motor carrier holding a permit to perform vehicle towing services, a licensed motor vehicle salvage dealer or a licensed motor vehicle dealer who performs vehicle towing services to remove and store such vehicle in any storage garage or rental parking grounds or any facility of the person providing the towing services. In addition to other to other penalties provided by this Code of Ordinances, the owner or operator of a vehicle so removed shall pay the cost of towing and storage.
